Former boxer Ali Nestor acquitted
Ali Nestor was accused of sexual assault and assault on a woman.
Charges of sexual assault and assault of a woman against Ali Nestor were dropped on Monday after the complainant withdrew from the case. The ex-boxer was thus acquitted.
This discontinuance of the prosecution is linked to a request made by Mr. Nestor and his lawyer, who wanted to obtain documents related to this case.
Under this request, the presiding judge must determine what constitutes a relevant document in the prosecution.
This is when the complainant wished to no longer be involved in this file. And without a complainant, the Director of Criminal and Penal Prosecutions had no choice but to acquit the accused, for lack of sufficient evidence.
A prosecutor can never compel a victim of domestic violence to testify.
No one, including Mr. Nestor and the complainant, has had to present his side of the story in this case.
Ali Nestor was formally charged in June 2021, about a month after the allegations against him became public. Mr. Nestor had just been appointed special adviser to the former mayor of Montreal Denis Coderre, who was then forming his team for the municipal elections of November 2021.
These allegations forced the former boxer's withdrawal from public life.
