Russia investigates first case of evasion of mobilization – human rights activist

In the Russian Federation, in the city of Penza, the first criminal case was initiated for evading mobilization. This was announced today, October 5, by the head of the international human rights group Agora Pavel Chikov.
“The case is being investigated by the Zarechensky Interdistrict Investigation Department of the TFR under Article 328 of the Criminal Code of the Russian Federation. He is 32 years old, he refused to sign a subpoena to the military commissariat. The investigator is due to go to court today with a request to select a preventive measure,” the human rights activist writes.
The suspect's lawyer has already filed a motion to terminate the criminal prosecution.< /p>
“The fact is that, according to the clarifications of the Supreme Court of the Russian Federation, Article 328 of the Criminal Code of the Russian Federation (Evasion of military and alternative civilian service – ed.) Applies only to citizens who evade conscription for urgent military service (paragraph 2 resolutions of the plenum),” Chikov notes.
Recall that the Russian Defense Minister assures that two-thirds of the announced number of reservists have already been called up.
