Pierre Ny St-Amand faces nine charges, including two of premeditated murder.

The Company driver de transport de Laval (STL) accused of having killed two children by driving his bus into the Ste-Rose Educational Daycare has been deemed fit to stand trial, according to the psychiatric evaluation ordered by Judge Carol Richer .

Accused in particular of premeditated murder, Pierre Ny St-Amand appeared for a third time at the Laval courthouse on Friday noon, after being transferred to the National Institute of Forensic Psychiatry Philippe-Pinel in Montreal for evaluation. .

As of today, Mr. is fit to stand trial[…], that means he is fit to understand what is going on in the legal proceedings, said Me Karine Dalphond, Crown prosecutor in the case, after the appearance.

Counsel for the accused also requested that his client undergo a further assessment regarding his criminal liability, which was granted. The assessment should take place within the next 30 days at the same institute.

Mr. Ny St-Amand will undergo his detention at the Philippe-Pinel National Institute of Forensic Psychiatry rather than in prison, while the evaluation is carried out, Me Dalphond explained to journalists.

The lawyer for the accused, Me Julien Lespérance Hudon, justified the new request for evaluation by invoking the facts, conversations I may have had with Mr. St-Amand or even the latest elements that we had on the aptitude, which lead him to believe that perhaps his criminal responsibility was not engaged for disorders of mental causes.

Me Lespérance Hudon declined to comment on his client's state of health, the results of the report being sealed.

If the first psychiatric assessment aimed to determine the aptitude of the accused at the time of his examination, the second assessment will determine the criminal responsibility at the time of the facts, being the morning of February 8, 2023.

“We have reasonable grounds – not to doubt – but to want more information about what happened that morning. »

Once established, the new psychiatric report may be submitted to a second opinion at the request of the defence, as well as the Crown.

Pierre Ny St-Amand faces nine counts: two of premeditated murder; one of attempted murder; two of aggravated assault; and four of assault causing bodily harm.
