Can the family collect the benefit of the deceased pensioner?

According to the “Interia” portal, in order to be able to collect the benefit of a deceased senior, strict conditions must be met. Payment of the benefit is subject to the need to submit an application to the Social Insurance Institution. Who can claim the benefit? What situations does this apply to?

Then the right to an old-age pension ceases

The right to an old-age pension expires upon the death of the person to whom the benefit was granted. However, many people wonder whether the benefit should be paid for the month in which the beneficiary died. If the benefit was credited to the pensioner's account in the month of his death, the family does not have to return it.

Money paid out for the month following the death of the person is considered undue. ZUS will then ask the bank to return the transfer sent to the deceased. If the deceased received the benefit by postal order, then the family of the deceased should not collect the benefit.

In the event that ZUS withholds the payment of the benefit for the month in which the senior died, the family may apply to the institution for payment of money.

Unpaid benefit from ZUS

The persons entitled to the unrealized benefit from ZUS are, first of all, the spouse of the deceased person and his children – provided that they formed a common household. Then, spouses and children who did not form a common household with the deceased may apply for it.

Finally, the benefit can be used by further members of the deceased's family who were dependent on the pensioner before his death. It is necessary to submit an ENS application. The following should be attached to the application:

a copy of the death certificate

the spouse submits a copy of the marriage certificate

children must submit a birth certificate

a statement or any evidence that the deceased was a householder with us.

The application may be submitted in person or by proxy at the Placó wce ZUS, as well as electronically via the Electronic Services Platform (PUE ZUS). The application must be submitted no later than 12 months from the date of death of the person concerned.
