He had applied to the investigating chamber of the Nîmes Court of Appeal. He also firmly denies having tried to kill his partner in September 2023 in the Bouillargues area. He has been in prison since September 2023. The court had kept him in detention. But a few days later, the investigating judge ordered the suspect's release because his condition was declared incompatible with detention. The suspect suffers from an inflammatory disease that led to the implementation of a medical assessment. After 14 months of pretrial detention, the thirty-year-old was released under strict judicial supervision. Before the investigating chamber, Mr. Dolez (Montpellier) had argued for electronic surveillance at home. “He suffers from an extremely severe form of Crohn's disease which is accompanied by a risk of infection and a vital intestinal lesion. He feeds exclusively on a powder like for babies and only eats this way”, the criminal lawyer had argued at the hearing of the Court of Appeal on December 4.
The case could be judged in the coming months by the Nîmes courts. The possibility of a requalification of the facts cannot be ruled out and would open the door to a case judged in correctional court for aggravated violence if the investigating judge were to rule out the intention to kill.
