Hans Nkinsi, ASBH player in Béziers, is sentenced to one year in prison, but is not imprisoned

ASBH rugby player Hans Nkinsi was sentenced this Monday, December 16, to one year in prison before the Béziers court for assaulting his ex-partner. He will also have to do a course on violence against women. Hans Nkinsi must wait a few days for the decision of the sentencing judge to know his future on the rugby pitches.

Hans Nkinsi, the second line of the ASBH, was sentenced this Monday, December 16 to 18 months of suspended prison sentence, including 12 months with a two-year probationary period. A previous sentence of 10 months of suspended prison sentence was revoked for six months and will be adjusted by the judge responsible for the application of sentences. In total, Hans Nkinsi is therefore sentenced to one year of firm detention, without a committal warrant. He was being prosecuted for repeat domestic violence.

Adjusting the sentence

“I'm going to make an appointment with the club's management to see how we can work so that Hans Nkinsi doesn't lose his job. Perhaps with an electronic bracelet, insisted, at the end of the hearing, Me Philippe Desruelles, the rugby player's lawyer. We will also have to see, of course, with the sentencing judge.”  During the hearing, Me Desruelles had mentioned“a judicial fiasco in which a man was prosecuted for criminal acts that were completely forgotten in the space of a few hours. Yes, I plead for acquittal because this is a case that has fizzled out. There are too many relatives of the victim who have come to testify about facts that date back years and are outside the time of prevention. She lied a lot and he was unable to justify himself. I don't understand why this case ended there with everything she had put forward. Why did we stop?”

The representative of the public prosecutor requested 14 months of detention, including 12 months with a 2-year probationary suspension, as well as the revocation of 4 months of the previous sentence for domestic violence, imposed on the player in April 2023 by the court from Aix-en-Provence.

“He is indeed a citizen like any other that we are judging today. Yes, there were acts of sexual violence that were reported. I don't see how we can not talk about it since all the parties are talking about it. But it is closed without further action. He is therefore innocent. On the other hand, as for domestic violence, there are elements. They are materialized. And I will show you that he is a violent man.” She will go over the elements of the case point by point to support the accusation. “Without adding anything, we see that he is always the one who is belittling, even if he says the opposite.”

For Me Iglesias, the lawyer of the victim who is ten years younger than the rugby player:“I am very surprised that he is under judicial supervision and not in pretrial detention. I do not know the rugby world, even less here. So I do not know if he is protected, but it makes me wonder.” And turning and berating the defendant: “You destroyed her. When you are a repeat offender like you, you do not minimize things. You take responsibility. All this is very complicated for her. I wonder if he came with a small bag because, for me, a small arrest warrant would do him good.”

Tensions

Enough to make Me Desruelles jump, which forced the president to intervene to calm things down. “You are making a spectacle of yourself and it is not dignified. Now you calm down and calmly resume the debates.” At the end of the hearing, Hans Nkinsi was taken to task by his victim's family. Insults and threats flew while the player was talking to his lawyer. “I will take charge of the press to make known who you really are and destroy you”, we heard.
