A business leader specializing in recycling in court, approvals at the heart of the legal debate

It was a very technical case that reached the bar of the Alès judicial court on Friday. A company specializing in the recycling and recovery of ferrous and non-ferrous metals was being prosecuted for various environmental offenses, as well as for undeclared work.

In January 2023, the business manager was taken into custody by the Salindres gendarmes. During the search of his home, €90,000 in cash was found. The defendant's bank accounts, from which investigators seized nearly €187,000, were frozen.

In court, the defendant admitted that he had started his car scrapping business in February 2022, “but on a very small part of the site. On less than 100 m2, which does not require authorization. At the same time, I hired a design office to prepare my regularization file.”

Pollution risk and undeclared work

Today, the company has obtained all the necessary permits. It even appears on the prefecture's listings.
Abdelkrim Grini, public prosecutor of Alès, considers that the offenses are characterized: “He acted in contempt of the provisions of the Environmental Code. He knew that he was carrying out a particular activity subject to authorizations. He had been warned and sanctioned by the administration. He had an obligation to be in compliance. In addition, the income declared does not conform to the reality of the activity. He only declares half of his turnover.”

The magistrate is requesting a suspended prison sentence of 6 to 8 months and a fine of €32,000. “For the money and accounts seized, I do not oppose their restitution after deduction of fines and debts to social organizations.”

On the other side of the bar, the defense lawyer, the president of the bar Guillaume Garcia, fulminates: “For two years, we have been waiting to justify ourselves. We will finally be able to explain ourselves. This case is the result of a rush and an overzealous policeman. It is not the opening of a Seveso factory in the middle of a residential area.”

A company that is now compliant

In a very technical plea, the lawyer disputes each violation. “Socotec confirmed that there was no pollution on the site and even less in the Avène. My client has reprocessed end-of-life vehicles ? Yes, for a limited period. Scrap metal is a profitable activity and for him, legal. Today, everything is regularized. He had a tax audit, he was corrected and all the increases applied.”

The decision is deliberated until March 11.
