Airbnb: Owners, you will pay much more taxes

It’s the end of an era. The Council of State has just decided to put an end to a tax loophole which benefited owners who place their accommodation for short-term rental. We first think of Airbnb, but this also concerns services such as Abritel or Booking.

Bad news for owners

In detail, the administrative jurisdiction decided to annul a provision maintained in error by the government which allows owners to benefit from a reduction of up to 71% of their rental income.

In 2023, Parliament voted to reduce this advantageous tax system from 71 to 30% in areas where access to housing is most difficult, but it was subsequently maintained at its maximum level without that we really know why.

Senators Ian Brossat (PCF) and Max Brisson (LR) and several hotel and tourist associations finally contacted the Council of State to request an end to this tax loophole. He agreed with them.

As one can imagine, the elected communist also welcomed this decision which he describes as “major political victory”. It should also be noted that this verdict is not retroactive. Clearly, it applies from now on, but theoretically does not concern your income obtained in previous years.

Cited by France Info, Ian Brossat however estimates: “In light of this deliberation, an association of taxpayers could consider attacking the State for the shortfall for public finances represented by the maintenance of this tax loophole against the opinion of Parliament”.

Good news for the general interest?

If this sounds like bad news for those affected, it is a great victory for all those who defended the end of this tax loophole. They felt that it was an injustice favoring tourist rentals to the detriment of the supply of affordable housing for locals.

We also remember that in 2023, four deputies from the left and the right had already tried to table a bill to put an end to this tax loophole. They then judged: “We think that this subject must be dealt with before the end of the legislature, because there is a social and ecological emergency. We hope that the government and the majority will be sensitive to our appeal and that they will help us to pass this bill”.
