Info Midi Libre. Rugby player Mohamed Haouas was to be tried in a “guilty plea” this Tuesday, February 4 for drunk driving. But the disclosure by the player's lawyer of the prosecutor's demands for a 3-month prison sentence prompted the prosecution to cancel the hearing and this proposal.

While international rugby player Mohamed Haouas was due to be tried this Tuesday, February 4 in a “guilty plea” hearing for drunk driving at the Montpellier judicial court, the hearing has simply been cancelled and postponed!

The reason ? A legal hiccup occurred this Monday, February 3, between the pillar's defense and the Montpellier prosecutor's office.

“The postponement is due to the fact that a confidential element communicated to the lawyer, and intended solely for him to facilitate the preparation of his work, was disclosed contrary to custom” Fabrice Bellargent, the Montpellier public prosecutor, told Midi Libre.

At the start, therefore, the athlete had been found asleep at the wheel of his car, in a double lane, engine running, then found drunk (1.8g in the blood), early December in Montpellier.

“There is a form of relentlessness against Haouas”

At the end of his police custody, he was summoned on February 4 for a “CRPC”: appearance with prior admission of guilt, a simplified procedure allowing the prosecution to propose a sentence, which may be validated by the defense, thus avoiding a “real trial.”

But this Monday, February 3, Me Marc Gallix, receiving the prosecutor's intentions to request three months in prison, lost his temper and mentioned these requests not to be announced until Tuesday, February 4 in the prosecutor's office.

“I cannot accept this sentence of 3 months in prison, it is not the case law for drunk driving! There is a form of relentlessness against Mohamed Haouas” justifies the lawyer to Midi Libre. But this revelation changes the situation.

The proposal of three months in prison “is no longer relevant”

“I consider that this proposal (of 3 months in prison, Editor's note) is no longer relevant” Fabrice Bellargent tells us.

Mohamed Haouas, already sentenced in the past to one year in prison for hitting his wife, 18 months including 9 in prison for a previous fight and suspended sentence for burglaries, again dating back more than ten years, will be summoned back to the prosecutor's office on February 27. Let's bet that the prosecutor's requisitions will be well kept secret.
