No technical inspection

The vehicle was also being driven without a mandatory technical inspection and its speed recorder was deactivated, said the public prosecutor, whose collective accidents unit, with interregional jurisdiction, is in charge of the investigation.

The investigators are interested in the Spanish tour operator “Chavi tours”. According to sources close to the case, the coach had not undergone a technical inspection for a year (October 2023), while Spanish regulations require it every six months.

Investigation opened

A judicial investigation, in particular for “involuntary manslaughter by deliberate violation of a particular obligation of prudence or safety” has been opened, the Marseille prosecutor's office said on Wednesday, December 4.

The investigation, entrusted to the gendarmerie of Prades (Pyrénées-Orientales) and the research section of the gendarmerie of Montpellier, also targets the same charge “by driver” and those of unintentional injuries and endangering the lives of others.

What happened ?

The vehicle, one side of which was torn off by friction against the rock face, appears to have crossed the road and hit the cliff. Testimonies cited by local authorities spoke of “zigzags” of the bus on the road before the impact.

The bus was on a day trip from Barcelona to Pas de la Casa, a town in Andorra known for its duty-free shops, and was on its way back when the accident occurred. “The vast majority” of the passengers were Colombians living in Spain and there was also a Spaniard, a Moroccan and an Ecuadorian, according to the Pyrénées-Orientales prefecture.
