Kylian Mbappé: interrogation, police custody, prison sentence… What does the Frenchman risk ?

“Kylian Mbappé: interrogation, custody, prison sentence… What does the Frenchman risk?”

Kylian Mbappé now reserves his word to the Swedish justice system according to his lawyer, what does the Frenchman really risk in this case?

The essentials

  • On Thursday, October 17, the Frenchman reportedly admitted to having had consensual sexual intercourse with one of the young women present on Thursday, October 10 at a party in Stockholm, according to information from RMC Sport and Le Parisien. The newspaper also claims that the player is relying on written messages testifying to “a happy meeting and a consensual relationship” with Kylian Mbappé after the young woman left the hotel. But there is no evidence at this time that this young woman is indeed the complainant who presented herself to the police a few hours later.
  • Also on Thursday, the player's lawyer told AFP that Kylian Mbappé “keeps primacy of his explanations” for the Swedish justice system, in the event that she would request it, also denouncing “firmly the media allegations suggesting that Kylian Mbappéé spoke out about the progress of his trip to Stockholm".
  • What is the risk for the French ? “When the suspicions are strong enough, we can start to consider questioning the suspect,” explained the prosecutor. “In some cases, the suspect's testimony is credible and the investigation can then be dropped immediately,” the prosecutor also explained. Furthermore, when the suspect is in another EU country and refuses or is unable to to go there, he can be questioned by the local police. If the case is confirmed and goes to its conclusion, in Sweden, rape is punishable by a prison sentence of three to six years. But for the moment Kylian Mbappé would still be considered as “reasonably suspicious” and this qualification rarely leads to pretrial detention.

10:30 – Press conferences expected

Carlo Ancelotti will be in a press conference with Real Madrid from 11am. If the Spanish press is discreet about the affair, some questions will certainly be about Kylian Mbappé and his affair. We will also follow Luis Enrique's press briefing at 1pm with PSG even if the Spanish coach is unlikely to say much on the subject.

10:00 – Mbappé heard, but from Spain ?

“If he does not go to Sweden, it is possible to hear him remotely. In this case, “this will be done by the local police who will receive the questions to be asked by the Swedish police,” explained Pernilla Dahlrot-Cabouillet, a lawyer at the Paris and Swedish bars, for BFM. “The prosecutor may want to have access to the data contained in the suspect's mobile phone,” Per Hedvall, head of the international judicial cooperation unit at the Swedish National Prosecutor's Office.

09:35 – Clothing swab a key element in the investigation ?

The complainant who underwent a medical examination and who allegedly filed a complaint against Kylian Mbappé was questioned by the police the following day, leading to samples being taken in the hotel room on Monday. A pair of black trousers, a top and a pair of panties were seized by the police, Expressen claims. The results of the analyses will prove or not the nature of the relationship, if there was a relationship.

09:05 – A flight worth 100,000 euros

According to the “calculations” of L'Equipe and the opinion of a pilot, Kylian Mbappé's little trip to Sweden would have cost him around 100,000 euros aboard an Embraer Legacy 550, a plane with a capacity of 8-seater operated by the Maltese company Luxaviation.

08:53 – Convictions have increased in Sweden

In Sweden, for an accused to be found guilty of rape, the prosecution must now prove that there is “absence of consent” from the victim, a concept that does not yet exist in French law. Convictions for rape in Sweden have increased by 75% to reach 333 in 2019, compared to 190 in 2017, according to a 2020 progress report from the National Council for Crime Prevention, one year after the law was put in place.

10/17/24- 11:07 PM – Why Kylian Mbappá is not saying more for the moment ?

ENDáLIVE – Kylian Mbappá's lawyer told AFP explained this Thursday, October 17, that the player does not wish to express himself further in the media for the moment, preferring to “keep the primacy of his explanations” for the Swedish justice system, in the event that it contacts him to have his version of the facts.
