Mbappé case: why the “rape” investigation has not been definitively buried and could potentially be reopened ?

On Thursday, December 12, the Swedish prosecutor's office decided to close the rape investigation due to insufficient evidence. The Stockholm prosecutor returned to the reasons for abandoning the investigation while giving more details, including a possible reopening of the case.

“I consider that the evidence is not sufficient to continue the procedure and the investigation is therefore closed”, explained in a press release Marina Chirakova, Stockholm prosecutor, in a press release released this Thursday, December 12. The same evening, a complaint for rape and two cases of sexual harassment had been filed by a single complainant. The Swedish media assured that the person targeted by this complaint was the Real Madrid striker. Finally, the investigation was closed this Thursday due to lack of evidence.

“I'm not going to confirm who the suspect was”

Questioned by BFMTV, prosecutor Marina Chirakova initially explained that the events took place “the same night” but “in different time frames”. She nevertheless explained that she could not “confirm who the suspect was.” “The investigation is closed because I found that the evidence collected is not sufficient to continue the investigation, so I decided to stop the preliminary investigation,” emphasizes Marina Chirakova.

The player could not be questioned as part of the investigation because under Swedish law, in the absence of formal suspicion, it is impossible to conduct an interrogation. “Without this, we are not allowed to question him,” she says. She also points out that there is “no evidence of lying” by the victim.

The victim can still appeal and the investigation reopened

If the victim has been informed of the prosecutor's decision, Swedish law still allows her to appeal and therefore request a “reconsideration” of this decision. This could allow the investigation to be reopened.

Another possibility for a reopening is the discovery of more important evidence. “This is the end of the case, but in the future, it is always possible to reopen it if new strong evidence arrives and can change my decision”, explains the prosecutor.
