Road crime in Gard: the promise of a “ruthless and uncompromising criminal policy” from the Alès public prosecutor

“La procédure est assez simple”, said Vincent Edel, the president of the immediate appearance hearing at the Alès court, on Monday, December 23. In the dock is a 31-year-old defendant, living in Robiac-Rochessadoule, who was stopped by the police on the RD 924 in Saint-Ambroix on December 21 while driving without a license and after taking hashish, amphetamines and cocaine. A repeat offender, he who regularly takes drugs, in a festive setting, explains that he got behind the wheel because his partner, who was at his side at the time, was suffering from neck pain.

The prosecution denounces “the carelessness, the recklessness”

Angry at the “explosion of road crime” which leads to “almost 50 deaths on the roads of Gard”, prosecutor Grini denounces “the carelessness, the recklessness of many drivers”, promising a “criminal policy ruthless and uncompromising”of the prosecution, with systematic immediate appearances. He is requesting 15 months in prison, six of which are suspended probation, a fine of €500 and a committal warrant.

Fighting against the committal warrant

For the defense lawyer, Me Euria Thomasian, this request is “extremely important, not proportionate to the efforts” that her client is making to get by and who is currently going through a difficult personal period. “I ask you not to issue a committal warrant”, she pleads. “I ask you to make a decision in all humanity. Tomorrow is Christmas.”

What do the magistrates of the court finally decide? ?

Finally, the court sentences this thirty-year-old to, among other things, 18 months of imprisonment, half of which is suspended probation, and a €500 fine. Without a committal order. “Not for a Christmas story”, specifies President Edel, warning that the next time, the sentence will not be reduced.
