He has been living hell since the accident in December 2022 when he lost a leg after a mechanical shovel fell on him. He was 19 years old and worked on construction sites in public works. At that time, Ismaïl was getting out of a trench when the mechanical shovel suddenly fell on his leg, seriously injuring him. Hospital, care, morphine, horrible pain, surgery and finally an amputation of the leg that could not be saved by the doctors so serious were the injuries.

Since December 2022, he has been living in hell, made all the worse by the fact that he has been faced with numerous and tedious administrative procedures, in addition to the care he had to receive. The case gave rise to an investigation by the police officers from the Beaucaire-Tarascon police station, who interviewed the victim and the people involved in the accident at work. It would seem that the elements of the investigation would reveal a bad maneuver by the machine operator. He would have greeted another work colleague and it was at this moment that the control lever would have accidentally lowered, causing the mechanical shovel to fall, crushing the teenager and ultimately leading to amputation.

“I really want to leave here”

Contacted this Friday, January 17, Ismaïl is now 21 years old and will be 22 next March. He confides that his life no longer has any meaning and that he even thought about committing suicide. No more friends, no more social relationships, “I live in Valdegour, I lost a leg, I don't see anyone anymore, here it's hard to live normally so with one leg missing, I only feel the negative sides of this environment. Sometimes, we hear gunshots. I really want to leave here, it's too hard to bear”, notes this Nîmes resident who insists on the length of his procedure which led to a police investigation and an investigation by the labor inspectorate.

Possible decision in the next few days

According to Me Camille Maury, the lawyer specializing in personal injury, “the police conducted their investigation perfectly, there is nothing to say about their speed, on the contrary. On the other hand, I do not understand why the labor inspectorate took so long to submit its report”, regrets the teenager's counsel. The lawyer does not hide her concern and sadness about the psychological situation of her client who has been waiting for more than two years for his case to reach its conclusion with the submission of the labor inspectorate report supported by the results of the police investigation.
 

The case could give rise to prosecution. But when the administrative report, targeting potential violations of labor law, it guides and conditions the opinion of the magistrate of the Nîmes public prosecutor's office to make a decision to prosecute or not. “When you see the seriousness of the injuries, you don't understand why this report is not yet in the file,” notes Mr. Maury. Questioned about the case, the Nîmes prosecutor's office indicated that the report should be communicated to them very soon.

“I can't stand taking the bus anymore, I've lost all my independence”

For his part, Ismaïl says he does not understand the length of his file and hopes to be recognized in his rights perhaps to rebuild and access a new life, try to change air, perhaps obtain a more efficient prosthesis. “I would also like to buy an automatic car to get around, I can't stand taking the bus anymore, I have lost all autonomy. I hardly leave my house anymore, I no longer have any taste for anything. I have already attempted suicide, I suffered a lot from the pain in my leg with the moral pain, all this has become very hard to bear”, notes the young man from Nîmes who tries to keep a glimmer of hope for the future. His rights ? Buy an automatic car ? Equip yourself with a new prosthesis ? In his small circle, the idea of ​​creating a kitty to help him and buy a car is mentioned while waiting for the procedures to be completed. On the courthouse side, it is indicated that it is a matter of days.
