At the head of a grocery store located in Paulhan, in the heart of Hérault, a 54-year-old fruit and vegetable wholesaler, his 32-year-old son and two of their employees, aged 35 and 55 respectively, were placed under judicial supervision, just before the end-of-year holidays.

The prosecution accuses them of acts of kidnapping and group violence followed by a total incapacity for work exceeding eight days. In this case twenty-one days. Committed on November 29.

That day, a former employee of the company was beaten up after being caught stealing from the grocery store, to which he had kept the codes.

According to our information, he was restrained and tied up in the cold room and beaten with a wooden handle, particularly on the head. He was also allegedly the victim of an attempt to insert a zucchini into his anus. But it broke in two just before penetration.

Attempted rape ?

“An attempted rape”, of a criminal nature, which led Maître Candice Tomasicchio, for the civil party, to request the referral to the judicial investigation of this case, some of the filmed scenes of this surge of violence having been seized on the defendants' mobile phones.

“They wanted to take justice into their own hands and that is prohibited by law!”, protested the representative of the public prosecutor's office. These are extremely serious facts for which they face ten years in prison. Who did what ? There are discrepancies in their statements.” And to request a judicial review for the head of the company and detention for the other three.

A so-called debt of €5,000 ?

“After identifying the thief, they filed three complaints but seeing that nothing was moving, they decided to install a camera. On the day of the incident, they realized that he was still helping himself generously. So they intervened and things got out of hand,”explained Maître Florian Medico, for the defense.

And Maître Tomasicchio added: “According to my client's statements, the grocer owed him money. €5,000 in total. Part of it had been paid to him. Not the other part. So he came to help himself to the equivalent of what his boss owed him.”

A strict judicial review

In view of a particularly busy hearing and a file that arrived late in the hands of the magistrates, the court decided to adjourn the case to February 21, without discussing the background.

All placed under judicial supervision, the four accused have an obligation to clock in, are prohibited from contacting each other and the victim, from appearing at her home as well as at the markets of Valras and Bessan where the two parties used to have stalls.

It should be noted that the attempted rape has not, for the time being, been retained by the prosecution.
