Donald Trump's lawyers have asked to overturn his New York criminal conviction for hidden payments to a porn star, citing a recent Supreme Court ruling that recognizes broad immunity from former president.

The highest American court with a conservative majority recognized on July 1, in an unprecedented decision, a certain criminal immunity for the president, a victory for Donald Trump faced with four criminal cases, a few months before the election which will oppose him to Joe Biden.

“The jury verdicts must be overturned and the indictment dismissed,” Donald Trump’s lawyers said in a document filed Thursday with of the judge in charge of his trial in New York, Juan Merchan.

The Republican was convicted on May 30 for 34 offenses of falsifying accounting documents, intended to hide a payment $130,000 to porn actress Stormy Daniels to avoid a sex scandal at the very end of her 2016 presidential campaign.

A historic trial: Donald Trump is the first former president of the United States to be criminally convicted.

The sentence in this case should have been handed down on Thursday, but this stage of the trial was postponed following the Supreme Court ruling. Judge Merchan assured that he would rule on the application for annulment on September 6 but that, if it was rejected, the sentence would be pronounced on September 18.

Manhattan District Attorney Alvin Bragg previously told the court that he was not opposed to delaying sentencing but found that “the defendant's arguments” regarding his request to overturn the conviction were “unfounded”.
