I hope I can finally get compensation,” confides Muriel, a former saleswoman at the Ila'Tout store in Sète. One evening in 2012, her boss Bruno Mure, who at the time owned the company managing the store, Setaffaires, unexpectedly moved the business, leaving some employees out in the cold. Muriel, on maternity leave with four children to support, lost her job overnight, without any severance pay, without any rights or compensation. With two other colleagues, she decided to take legal action. In particular, at the industrial tribunal.
On December 7, 2022, the social chamber of the Court of Appeal issued a judgment in which it considered that Muriel had indeed been dismissed without real and serious cause and ordered Bruno Mure and his company Gigaffaires (recognized as Muriel's co-employer) to pay her severance pay, compensatory notice pay, and €10,000 in damages for unfair dismissal.
Bruno Mure had challenged this decision on the form before the Court of Cassation. However, on January 15, 2025, the latter rejected the plaintiff's arguments and thus validated the judgment of the Montpellier Court of Appeal and required Bruno Mure to reimburse the legal costs incurred by Muriel. A first employee had won her case in the same way a year ago. In addition, Bruno Mure was convicted by the Court of Appeal for fraudulent organization of insolvency and forgery and use of forgery on February 28, 2024, where three employees filed civil actions. Bruno Mure also filed an appeal in cassation on this aspect. It is still ongoing.
