Since a law passed in May 2024, Arcom has been given new powers to regulate access to pornographic sites in France to better protect minors. The administrative authority can thus impose financial sanctions on these platforms or order their blocking if they do not implement measures to verify the age of users.
How will this work ?
L’Informé has managed to get its hands on a technical document that is supposed to accompany these portals. For the moment, the Internet policeman specifies that it will temporarily accept age verification by credit card.
The sites in question now have three months to launch this verification procedure. This will open a new three-month period where the bank card can be used, for example via zero-euro transactions. This will take us to April 2025.
Our colleagues also point out that this system will have to be managed by an independent third party and not directly by the X platforms. However, the latter will have to ensure that this process is secure for their customers. In this regard, the idea seems to be to avoid potential scams that may occur once this process is launched.

This provisional verification system is applicable to French players in the sector such as Jacquie et Michel, as well as those established outside the European Union. However, a large proportion of these players are located in another EU country. This is the case for YouPorn, Pornhub, and Xnxx. For the time being, these players are not affected by this new procedure and a decree from the Ministries of Culture and Digital Affairs will soon decide their case.
France should then ask the countries concerned to act. In the event of no reaction or insufficient action, Arcom would then take over, provided that the European Commission asks it to do so. Finally, note that an emergency procedure could allow the government to act while justifying its decision to the EU authorities and the Member State concerned.
Finally, let us point out that from April 2025, adult sites will be able to choose the verification solution that suits them, provided that they comply with Arcom’s requirements.
